Artificial Intelligence Usage Notice

Ady Media Design utilizes AI models that are licensed, open-source and/or freely available for commercial and non-commercial use. The primary model employed are  Stable Diffusion, along with other models released under open licenses for free use, including but not limited to the following:

• Stable Diffusion (Licensed under the CreativeML Open RAIL-M License),
• Real-ESRGAN and GFPGAN,
• ChatGPT, DALL·E and OpenAI,
• Other AI models available under Apache 2.0, MIT, or similar licenses that explicitly allow both free commercial and non-commercial usage.

By using our services, you agree to comply with the respective licenses attached to each model. These licenses permit the use of the models for generating content for both personal and commercial purposes, with certain limitations as specified below.

The images, text, or video generated by AI using the models mentioned above are not subject to automatic copyright protection in many jurisdictions, as the content is generated by an algorithm. However, the input prompt and any manual curation or adjustments provided by the user may qualify as creative input, potentially leading to copyright eligibility under local laws.

Unless otherwise specified, Ady Media Design transfers all commercial usage rights of the generated content to the client, allowing the client to use the content freely in commercial and non-commercial settings. However, the client assumes full responsibility for ensuring that the content does not infringe on third-party intellectual property rights or violate any laws.

The client is responsible for ensuring that the generated content does not infringe upon any third-party rights, including copyrights, trademarks, or likenesses of individuals. Ady Media Design disclaims any responsibility for legal actions that may arise from the use of content in violation of third-party rights.

The generated content should not replicate, reference, or imitate any copyrighted material, trademarked symbols, or proprietary styles without appropriate permissions from the rights holders.

The following restrictions apply to the use of AI-generated content:

• No illegal, harmful, or offensive content: The generated content cannot be used for any illegal or harmful purposes, including but not limited to promoting violence, hate speech, or any form of discrimination.
• No deepfakes or misrepresentation: The content generated using AI must not be used in a misleading or deceptive manner, including the creation of deepfakes or manipulation that misrepresents individuals or events.
• No usage in regulated industries without permission: AI-generated content should not be used in regulated industries (such as finance, healthcare, or legal) without proper approvals and regulatory compliance.

The prompt or any data submitted by the client for the purpose of generating AI content will be handled in accordance with our Privacy Policy. We do not store, retain, or use the input data beyond the scope of generating the requested content unless explicitly authorized by the client.

Ady Media Design does not guarantee the uniqueness or exclusivity of any AI-generated content. AI models may generate similar or identical outputs based on similar input prompts provided by other users.

The client agrees that Ady Media Design is not liable for any damages, direct or indirect, arising from the use, misuse, or inability to use the AI-generated content.

The models used for content generation, including Stable Diffusion Public Release, Real-ESRGAN, and GFPGAN, are all distributed under free commercial-use licenses, as follows:

• Stable Diffusion: Licensed under the CreativeML Open RAIL-M License, which permits commercial use with certain ethical and legal restrictions, including a prohibition on harmful or malicious use.
• Real-ESRGAN: Distributed under an Apache 2.0 License, allowing free commercial use.
• GFPGAN: Distributed under the MIT License, which allows unrestricted commercial use.
• For additional AI models, we ensure that each is used under the appropriate license, guaranteeing that all content generated adheres to the licensing terms that allow free commercial usage.

Ady Media Design reserves the right to terminate or suspend the client’s access to the AI-generated content services at any time if the client is found to be in violation of these Terms and Conditions or if the content being generated is determined to be in violation of applicable laws or licenses.

These Terms and Conditions are governed by and construed in accordance with the laws of Romania. Any disputes arising in connection with these terms will be resolved in the courts of Romania.
